How to register a car in the traffic police for DKP.
First of all, before visiting the traffic police, you need to pass technical inspection, and after that issue an OSAGO policy for the purchased vehicle, where the new owner must be indicated by the owner. The general algorithm for the sequence of actions when selling a car includes:
- Analysis of offers on the market: identify the strengths and weaknesses of your car, determine the cost of the vehicle.
- Checking the information of all documents related to both the car and personal data necessary for drawing up a sales contract for the accuracy of the information and the absence of errors and inaccuracies.
- If the car is not owned (it was bought on credit, is pledged to the bank), you should submit an application to the bank branch about the intention to sell the vehicle and obtain permission for the transaction from it.
- Pre-sale preparation of the vehicle:
— Wash the body, eliminate the shortcomings of the cabin (do dry cleaning);

- documents of the owner confirming the ownership of the car;
- rights and obligations of both the seller and the buyer;
- the price of the car not only in numbers, but also in words;
- the sequence and conditions for the transfer of funds for the vehicle.
Both parties sign three copies of the sales contract, one remains with the buyer and the seller, the third is transferred to the traffic police.
Transfer of money

As an alternative, the buyer can also offer payment in installments. In this case, a payment schedule is prescribed in the contract as a separate clause, after which the car is registered in the name of the buyer. If the new owner of the vehicle does not make payments, then the previous owner will be able to return his money only through the court. The seller runs the risk of selling his car and not getting paid for it, so it is better to refuse the option of a contract with payment in installments.

The seller, after completing the transaction, is obliged, by submitting a declaration to the tax authority, to report for the proceeds from the sale of the car, while the tax rate is 13% and is calculated based on the resulting difference in amounts (the cost of the vehicle minus 250 thousand rubles).
The law exempts from paying tax if the car was owned by the owner for more than three years or the value of the vehicle under the contract does not exceed 250 thousand rubles.
Despite this, the former owner of the car is still required to submit a declaration of the form 3-personal income tax until April 30 next year after selling the car. Since the tax office calculates by months, the period of car ownership should also be determined based on the number of months, not years.

Nuances of self-selling

I would not say that this method is bad. But he is not enough. Don't judge cars superficially. Carefully analyze all its advantages and disadvantages. And my selection of objective criteria for the cost of a car will help you with this.
1) Make and model
No outbid will put the price lower than other sellers. And the point here is not the desire to "grab more." The low price raises suspicion: what if the car was in an accident or even stolen?
Start counting from the average market price for your brand and model. For example, in one place a BMW 750 is sold for 230,000, in another - for 280, in a third - for 310,000 rubles. Average price: 270,000 rubles. From it we repel.
2) Year of manufacture

3) Mileage
It is believed that a non-commercial car rolls 10-15 thousand kilometers per year. That is, if you have a ten-year-old in front of you, its mileage will be 100-150 thousand. I will tell you this: for a city car, in which they only rode home from work, and once a week to a country house located 20 kilometers from the city, 10-15 thousand a year is a normal result.

If you are not included in the "official" statistics - do not worry. Smart people will figure out what's what. If the car is well-groomed, the mileage above the norm will not frighten. How was a car resold in the old days? So, the buyer is found, the price is negotiated, you can start the deal. First, make sure that the TCP has at least one free column where you can enter the data of the new owner. If the main document of the car is already filled out, you will have to get a new one from the traffic police. Otherwise, there will be nowhere to reflect the information about the buyer. Moreover, we do not recommend changing the form on your own initiative in advance. The inscription may scare off a potential buyer, and the sale will be delayed. It is better to show the original, in which the history of the car will be visible.
How to fill out a car purchase agreement?
The sale and purchase agreement can be written on a blank sheet of paper, but it is easier to download such an agreement (links to samples of the necessary documents at the end of the article) and print it. You can fill in the required fields by hand. Only it is better to fill out the entire contract with one hand and one pen, so that the new owner does not have additional difficulties when registering with the traffic police. The inspector may question the authenticity of such a document.
The date and place of its compilation, the cost of the vehicle, the last name, first name, patronymic of the seller and buyer, their addresses and passport data, identification data of the vehicle (make, model, color, year of manufacture, VIN), series, number, the date of issue of the vehicle passport (PTS), as well as the data of the registration document (STS) and the state number (if any). It would be useful to indicate that the buyer accepts the vehicle in good condition and has no claims.
The contract is drawn up in triplicate. One remains with the seller, two - with the buyer, who, in turn, will give one to the traffic police when registering the car.
How to fill out PTS?
Now you can start filling out the PTS. In the new field (there are six in total on the form), you must indicate the full name of the new owner, his address of registration and the date of the transaction. In the column “Document of ownership” we simply indicate “Purchase and sale agreement from such and such date”. The seller (the former owner) and the buyer (the present owner) put their signatures below. If the car is sold by a legal entity, then you will need to put its seal.
When to transfer money?
Exchanging money for a car is the most slippery issue of the transaction. Each of the parties (and most often these are strangers) to a certain extent does not trust the partner. From a legal point of view, ownership passes with the signing of a sales contract. Therefore, having filled out the contract and the TCP, it is better not to sign them immediately. It is more correct to do this directly at the time of calculation. receives money, the buyer - documents and car keys. At the same time, the parties, by their autographs in the contract and the TCP, certify that the transaction has taken place.
Do I need a car transfer certificate?
In addition to the above documents, we recommend that you draw up an act of acceptance and transfer of the car. He will separately confirm the fact of the transfer of property to the new owner. It needs to be set to the correct time. The fact is that the law gives the buyer ten days to re-register the car. Up to this point, for violation cameras, it belongs to you. Which documents remain with the former owner, and which are transferred to the new one?
The former owner gives the buyer TCP. Later, the traffic police will add the remaining information to this passport, and the STS will issue a new one.
As for the previous certificate of registration of the vehicle, it is usually given to the new owner, and he, in turn, submits this document to the traffic police when re-registering the car. So the inspector has less reason to doubt the legality of the transaction for the sale of the car. But formally, the STS does not have to be handed over to the traffic police.
Moreover, if there are doubts about the good faith of the buyer, it is better to keep the CTC. Indeed, in theory, the new owner will be able to drive with your STS until you contact the traffic police for deregistration. All this time and transport tax.
Number replacement
License plates remain on the vehicle. If the seller wants to keep the numbers for the next car, he must first re-register the car before selling. The old "tins" will remain in storage in the traffic police department for 180 days, with the new ones the vehicle will go to the buyer. In turn, the buyer can also ask to replace the numbers when registering the purchase in his name.
Do I need to apply for a new OSAGO policy?
The OSAGO policy remains with the former owner. In it, you can change the list of persons admitted to driving and the owner of the car, but not the policyholder. And this is the main person for the insurance company! In the event of an accident, she will conduct business with him - the old owner. That is, the new owner will have to look for a seller or, at the time of buying a car, take a power of attorney from him to represent interests from the insurer. Are such complexities worth the few thousand rubles saved?
But the seller can still benefit from the old OSAGO policy. It is enough to come to the office of the insurance company and write an application for termination of the contract and the return of part of the paid insurance premium. Interestingly, the law does not allow you to do this procedure “just like that” (for example, if you decide not to use the car for several months). The insurer must provide documents confirming the sale of the car.
To issue a new OSAGO policy, the buyer of the car must first receive. So, if it has not yet expired, the seller can give it to the new owner. Please note that the buyer has 10 days from the date of the transaction to issue a new OSAGO policy.

How fast is the car registered?
The new owner has 5 days to register the transaction, if the deadline is violated, a fine is provided. It is necessary to contact the MREO STSI (interdistrict registration department) at the place of residence, providing the necessary documents there, we list them again:
- registration certificate;
- Vehicle registration certificate;
- OSAGO policy;
- The passport;
- Receipts for payment of administrative procedures - for issuing a certificate and making changes to the TCP;
- Valid passport or identity document;
- Contract of sale;
- Application filled in MREO according to the sample.
In about 1-2 hours, the driver will be issued a new vehicle registration certificate. That's all - you can safely use the machine.
What to do if the buyer does not register the car?
The new owner has 10 days to register the car. If he does not meet this deadline, then formally the car continues to be registered with the old owner. To avoid unfounded claims against you, after 10 days you can contact the traffic police and find out if the car has been re-registered. If there is no record, write a statement about the termination of registration: from now on, problems with the car are not your problems.
Do I need to pay tax on the sale of a car in Russia?
According to clause 17.1 of article 217 of the Tax Code of the Russian Federation, it is not necessary to pay tax after the sale of a car if the item has been owned for 3 years or more. You will also not have to submit a declaration to the authority of the Ministry of Taxes and Taxes at the place of residence. In addition, those purchasers of transport who bought it more expensive and sold it cheaper are also exempted from transferring money to the state.
